{"id":6288,"date":"2023-04-13T14:51:28","date_gmt":"2023-04-13T18:51:28","guid":{"rendered":"https:\/\/realtyincanada.com\/?p=6288"},"modified":"2023-04-13T15:36:09","modified_gmt":"2023-04-13T19:36:09","slug":"prohibition-on-the-purchase-of-residential-property-by-non-canadians-act-come-into-effect","status":"publish","type":"post","link":"https:\/\/realtyincanada.com\/fr\/prohibition-on-the-purchase-of-residential-property-by-non-canadians-act-come-into-effect\/","title":{"rendered":"Interdiction d&rsquo;acheter propri\u00e9t\u00e9 r\u00e9sidentielle"},"content":{"rendered":"<p><strong>Nouvelle mise \u00e0 jour:\u00a0<\/strong>Entr\u00e9e en vigueur le 1er janvier 2023, la Loi sur l\u2019interdiction d\u2019achat d\u2019immeubles r\u00e9sidentiels par des non-Canadiens emp\u00eache les non-Canadiens d\u2019acheter des immeubles r\u00e9sidentiels au Canada pendant 2 ans.<\/p>\n<p><strong>*** NOUVEAU : MODIFICATIONS AU R\u00c8GLEMENT le 27 mars 2023<\/strong><\/p>\n<p>Les modifications, qui sont entr\u00e9es en vigueur le 27 mars 2023, \u00e9largissent les exceptions afin de permettre aux non-Canadiens d\u2019acheter une habitation dans certaines circonstances.<\/p>\n<p><strong>Modifications:<\/strong><\/p>\n<p><strong>1. L\u2019alin\u00e9a a) de la d\u00e9finition de contr\u00f4le, \u00e0 l\u2019article 1 du R\u00e8glement sur l\u2019interdiction d\u2019achat d\u2019immeubles r\u00e9sidentiels par des non-Canadiens , est remplac\u00e9 par ce qui suit :<\/strong><\/p>\n<p>a) soit de la propri\u00e9t\u00e9 directe ou indirecte d\u2019actions ou de titres de participation qui repr\u00e9sentent 10 % ou plus de la valeur des capitaux qui lui sont propres, ou lui conf\u00e9rant 10 % ou plus des droits de vote;<strong>\u00a0OU<\/strong><\/p>\n<p><strong>2. L\u2019alin\u00e9a 2b) du m\u00eame r\u00e8glement est remplac\u00e9 par ce qui suit :<\/strong><\/p>\n<p><strong>b)<\/strong>\u00a0l\u2019entit\u00e9 constitu\u00e9e en vertu des lois du Canada ou d\u2019une province dont les actions ou les titres de participation ne sont pas cot\u00e9s \u00e0 une bourse de valeurs d\u00e9sign\u00e9e en vertu de l\u2019article 262 de la Loi de l\u2019imp\u00f4t sur le revenu et qui est contr\u00f4l\u00e9e par l\u2019entit\u00e9 vis\u00e9e \u00e0 l\u2019alin\u00e9a a) ou par la personne vis\u00e9e aux alin\u00e9as a), b) ou c) de la d\u00e9finition de non-Canadien \u00e0 l\u2019article 2 de la Loi.<\/p>\n<p><strong>3. Le\u00a0<\/strong><strong>paragraphe 3(2) du m\u00eame r\u00e8glement est abrog\u00e9.<\/strong><\/p>\n<p><strong>4.
